GENERAL CONDITIONS

I. Introductory Provisions

Art. 1. (Scope)
These Terms and Conditions govern the relationship between Kapsio BG Ltd., which operates the e-shop capsiobg.com, hereinafter referred to as „Provider“ or „Seller“, and any person using the services of the e-shop capsiobg.com, hereinafter referred to as „User“ or „Customer“.

Art. 2. (Consent)
The use of the e-shop, as well as placing an order, means that the User has read, understood and unconditionally agreed to these Terms and Conditions, the Privacy Policy and the Payment Methods published on capsiobg.com.

Art. 3. (Subject matter of the contract)
The Supplier shall provide the User with the opportunity to order remotely via an electronic order submitted through the website. capsiobg.com, precisely dosed flavourings and sauces in individual capsules, as well as related products, payment can be made in advance or by cash on delivery upon receipt of the shipment by courier.

Article 4 (Nature of products)
All products offered in capsiobg.com, are intended for end users and/or business customers and are precisely dosed flavourings, sauces and other related products offered in individual capsules or other suitable packaging. Detailed information on product type, contents, quantity, method of use, storage conditions and expiry date is given on the product page of the respective item.

II. Contract procedure and purchase steps

The distance selling contract is considered concluded from the moment of order confirmation by the Supplier. Where the User has opted for prepayment, the execution of the order shall commence upon receipt of the amount due. Where cash on delivery has been selected, payment shall be made on receipt of the shipment by the courier. The order process includes the following mandatory steps:

Art. 5. (Product selection)

Step 1: The user selects a product from the relevant category, including flavourings, sauces, capsules and other products offered through the site.
Step 2: The user selects the desired quantity, variant or packaging of the product when different options are available for the respective item.
Step 3: The user adds the selected product to the Cart by clicking „Add to cart“.

Art. 6. (Review and Finalization)

Step 4: Review the Shopping Cart for a final check of all selected products and quantities.
Step 5: Pressing the button „Finalise order“.
Step 6: Delivery details - The user fills in the required fields with accurate and up-to-date data (Name, Address, Phone, Email) and selects the delivery method (delivery is made by courier company, currently Econt).

Art. 7. (Payment and Consent)

Step 7: User proceeds to checkout by the payment method selected and indicated on the website. To ensure the security of transactions, the Provider may use licensed payment processors (e.g. Stripe) to process payments. capsiobg.com does not store bank/card data; all data is processed directly by the respective payment operator.

Step 8: The User must declare that he/she has read and agrees to the Terms and Conditions, Privacy Policy and Payment Methods by ticking the appropriate box.

Step 9: The order is completed with a button „Complete Order“.

Art. 8. (Execution of the contract)
The order shall be deemed to be accepted for execution upon confirmation by the Supplier. In the case of a prepayment option, the execution of the order starts after confirmation of payment received. If cash on delivery is selected, the order shall be executed after confirmation of the order by the Supplier. The Supplier has the right to refuse to execute an order in the absence of payment in the case of prepayment, in the case of suspected abuse or in the case of an obvious error in the price or description of the product, in which case it shall notify the User to the email provided by the User.

III. Prices, Payment and Terms

Art. 9. (Prices)
All prices listed on the website are in euro (EUR) and are final (inclusive of all taxes and fees payable unless otherwise stated). The shipping cost is added to the final amount and displayed before the order is finalized.

Art. 10. (Methods of payment)
Specific payment methods are described on the page „Payment methods“ at capsiobg.com and may include, but are not limited to:

  1. Payment by cash on delivery upon receipt of the shipment by courier.

  2. Online payment by bank card, processed through a licensed payment system (e.g. Stripe) if such option is available at the time of order.

The currently valid payment methods are those displayed and active in the checkout process at the time of finalization.

Art. 11. (Time limits)

  • Deadline for preparation and delivery of the shipment to the courier: To 3 (three) working days after payment has been received, unless a different deadline is specified on the specific product page or when finalizing the order.

  • Delivery time: usually from 1 to 2 working days after handing over the parcel to the courier, depending on the location and conditions of the courier company.

IV. Delivery

Art. 12. (Courier)
Deliveries are made by courier company Econt or another courier company with which the Supplier has a contract, to the address or office / courier machine specified by the User, according to the option chosen by the User.

Art. 13. (Risk)
The risk of damage or loss of the goods passes to the User from the moment of delivery of the goods to the courier. Upon receipt of the shipment, the User is obliged to inspect the packaging for visible damage and, if found, immediately notify the courier and/or the Supplier.

V. Withdrawal from contract and claims

Art. 14. (Right of withdrawal)

  1. The consumer has the right to withdraw from the distance contract without giving a reason within a period of 14 (fourteen) days, as of the date of receipt of the goods, under the terms and conditions of the Consumer Protection Act (CPA), except in the cases under Article 57 of the CPA.

  2. Exceptions to the right of withdrawal may be available for:

    • goods with a short shelf-life or goods which, by their nature, may deteriorate or have a short shelf-life;

    • sealed goods which cannot be returned for reasons of hygiene or health protection and which are unsealed after delivery.
      The specific opt-out option for each product type shall apply in accordance with the PPA.

  3. In order to exercise the right of withdrawal, the User should notify the Provider by email to sale@capsiobg.com  or by any other means indicated on the website, by providing order details (order number, name, telephone, email, address and details of the product purchased).

  4. Where the right of withdrawal has been validly exercised and the product is subject to return, the User shall return the goods in commercial condition, in the original packaging and with all accompanying documents, unless otherwise agreed. The cost of returning the goods shall be borne by the User, unless otherwise specified by the Supplier.

Art. 15. (Complaints)

  1. Complaints are accepted when product defect, non-compliance with the agreed quantity, missing part of the requested quantity or other defect due to the Supplier's fault.

  2. The complaint should be submitted by email sale@capsiobg.com within a reasonable time after the non-compliance has been identified, and it is recommended that this be done within 48 hours of receipt of shipment, accompanied, if possible, by photographs and a brief description of the problem.

  3. The Supplier shall examine the complaint within the time limit provided for by the Consumer Protection Act and shall notify the Consumer of the result and the manner of its satisfaction - repair, replacement, price reduction or refund of the amount paid, in accordance with the Consumer Protection Act.

VI. Final Provisions

Art. 16. (Applicable law)
All matters not covered by these Terms and Conditions shall be subject to Bulgarian legislation, including, but not limited to, the Consumer Protection Act, the E-Commerce Act and applicable regulations.

Art. 17. (Amendments to the General Terms and Conditions)
The Provider has the right to amend and supplement these General Terms and Conditions. Amendments shall take effect from their publication on capsiobg.com and apply to all orders placed after that date.
